Sacramento Motorcycle Accident Leaves One Dead, Another Critically Injured

A 50-year-old woman who was riding as a passenger was killed in a Sacramento motorcycle accident this past Saturday night. According to Sacramento news, the woman and her driver were thrown from the motorcycle after being hit by a car that was heading north. The driver of the car was uninjured, but the driver of the motorcycle sustained serious injuries.

If you have been injured in a car accident or motorcycle accident, it is important to contact an experienced California personal injury lawyer to evaluate your case and help you obtain compensation.

The potential for an injury from a motorcycle accident is great. Because of the lack of any shell protecting the rider from the full force of a crash, falls from motorcycles may result in serious, even fatal injuries. In an effort to increase safety and awareness, NHTSA has created safety initiatives combining outreach, legislation and enforcement to minimize the risk of injury when a crash occurs.

For example wearing a helmet can significantly decrease the risk of a head or brain injury. In order to promote safety, NHTSA as designated May as "Motorcycle Safety Awareness Month."

Whether wearing a helmet would have altered the outcome in this situation is unknown. However, helmet usage remains the number one safety tip to follow to avoid serious injury.

Fatal Portola Bike/Truck Collision Leads To Claim Of Negligence Against San Mateo County

Last year's Portola Valley fatal bicycle accident has now resulted in a wrongful death lawsuit against the truck driver involved in the collision and his employer. The truck versus bicycle accident occurred last November and ended in the death of a 47-year-old Los Altos Hills woman.

The truck driver and his company have now counter-sued, seeking indemnity from San Mateo County. The suit alleged that the accident was "caused by a dangerous condition on public property created on or maintained by the County of San Mateo." A representative of the company notes "The road is poorly designed and can be a 'trap for bicyclists."

If you or a loved one has been injured seriously injured in an accident, it is critical to contact an experienced California personal injury attorney to explore your options and seek compensation for your harm.

Several different sources of fault may exist for one accident, each leading to different theories and avenues of recovery. In some cases, driver error may be to blame. In others, an employer may have negligently hired a driver, or may push drivers to perform under unsafe conditions. And in others, such as is alleged here, roadway design or maintenance may have a direct correlation to an accident.

An experienced accident attorney will investigate all the factors surrounding a particular incident and be able to help you obtain the compensation you deserve.

Monterey Big Rig Accident Leads To Injuries And Delays

A Monterey big rig accident on Highway 101 resulted in minor injuries, as well as major delays. The California truck accident occurred early Friday morning near Espinoza Road.

If you have been injured in a truck accident, contact a California truck accident lawyer immediately to protect your rights and begin investigating the factors involved.

Here, a truck loaded with thousands of pounds of vegetables overturned, leading to one highway lane being closed while crews clean up the site. The cause of the accident is still under investigation.

While no one was seriously injured in this big rig accident, it is important to keep in mind the potential for danger when trucks lose control. Because of the sheer magnitude of force behind an 18-wheeler, when a big rig loses traction on a slippery road, or its brakes fails on a decline, or its driver has to maneuver quickly to avoid colliding with another vehicle, serious and even fatal injuries can occur.

Those injured in trucking accidents may suffer significant harm, including physical and emotional injuries and pain and suffering. While sometimes truck driver error is to blame for an accident, many times other factors such as defective parts, roadway conditions or employer demands may be responsible.

After Boating Accident, San Francisco Cruise Ship Set to Sail

San Francisco news reports that the Carnival Cruise Ship damaged after catching fire during a voyage in November will set sail out of its San Francisco port next week.

The ship's problems gained national attention after catching fire while out at sea. While no one was reported injured, passengers were stuck at sea for three days. Coast Guard assistance was required to bring in food, water, and medical supplies.

If you have sustained injuries in a boating accident - whether on a personal watercraft, cruise ship or a commercial boat - a complex set of laws govern filing a lawsuit and obtaining compensation. It is critical to contact a experienced California boat accident lawyer to advise you regarding your rights.

Many times a combination of laws govern when a lawsuit must be filed, where it can be filed, and who may be found responsible. When cruise ships are involved, a contract may exist requiring you to file your lawsuit in a specific state. If the cruise ship originates out of a foreign country, it may be necessary to look to international law.

Oakland Has Fewest DUI Accidents Among California's Big Cities

The Oakland Tribune reports that Oakland has the fewest DUI car crashes among California's biggest cities. The study reviewed 13 of the state's biggest cities, including San Francisco and Sacramento.

The number of Oakland pedestrian accidents and hit-and-run injuries placed them at #3. Oakland ranked #5 for bike accidents.

If you have been injured in a DUI accident, or any other injury throughout the Bay Area, an experienced California personal injury lawyer can help.

The study reports that the 131 people were injured or killed in Oakland accidents where alcohol was involved. Although this number is still too high, it is a significant improvement. The city's partnership with a number of nationwide and statewide sobriety programs is credited with the improvement.

The Oakland Police Department has just received a traffic safety grant to look at ways to improve bicycle and pedestrian safety.

Many factors are at play in any type of accident. Roadway conditions, driver distraction, and simple awareness of the rules of the road all impact the number, type and severity of roadway collisions and accidents. A knowledgeable California personal injury attorney can investigate the facts surrounding any accident and evaluate your options.

Corte Madera Class Aims At Reducing Car Accidents

As the result of numerous fatal and serious California car accidents, Corte Madera has started the Start Smart safe driving program designed to teach teen drivers about road safety and the dangers of drunk driving. One person attending was from Novato High School where a drunk driving accident recently claimed the life of a classmate.

One method the Smart Start program uses to teach about the effects of drinking on your driving skills is to provide goggles that simulate the effects of being intoxicated. Wearing the goggles, students are instructed to try to complete common field sobriety tests. They also shown instructional - and frightening - films such as "Red Asphalt" designed to warn teens about the dangers of drink and driving, as well as distracted driving.

According to the Novato Patch, teens account for 14% of traffic deaths in California, with the most common reasons being drunk driving and distracted driving. Statistically distracted driving has been shown to be more dangerous than drunk driving due in large part to the frequency teens text and drive and the misguided belief that you can send "a quick text" without losing focus on the road.

As a California personal injury attorney I support classes such as these that educate teens about the real dangers associated with driving and try to prevent future serious accidents and deaths.

California Wrongful Death Case Filed In Deadly CHP Car Accident

A 23-year-old California woman now faces a wrongful death lawsuit arising out of a car crash that killed CHP Officer Brett Oswald. Kaylee Ann Weisenberg was speeding and high on methamphetamine when the crash occurred. She was driving too fast when she turned a corner and lost control of her car. Oswald was out of his vehicle at the time, and was struck by his own patrol car after Weisenberg crashed into it. Oswald was a 21-year veteran of the CHP.

As a result of the fatal car accident, Weisenberg faces four criminal charges, including murder. Oswald's family has now filed a civil suit for personal injury, wrongful death and property damage. A wrongful death lawsuit can be brought by the family of a victim killed by the negligent, careless, intentional or reckless acts of another.

Under California law, the families of those killed in a wrongful death lawsuit are entitled to compensation including medical costs, funeral expenses, loss of love and companionship, lost financial support and in some cases, punitive damages. An experienced California personal injury attorney can advise you concerning your options.

A representative for the family states that any compensation they receive as the result of a lawsuit will go to a memorial fund to help other young people become members of law enforcement.

Atherton Woman Arrested For DUI After Injuring Two

According to the San Jose Mercury News, a 62-year-old woman was arrested on suspicion of DUI after she was involved in two hit and run drunk driving accidents minutes apart. First, she injured two people while backing out of a parking space. She hit two different parked cars, pinning one man between the cars and injuring another woman who was sitting inside. The man sustained serious, non-life threatening injuries and was taken to Stanford Hospital.

In California and throughout the United States, drunk driving remains the leading cause of auto accidents causing injuries and fatalities.

Here, the extent of the man's injuries are unknown but will undoubtedly create medical expenses, possible rehabilitation and lost time at work, pain and suffering, and significant inconvenience.

Victims of drunk driving may be able to obtain compensation for these damages.

Fewer Sacramento Car Accidents Over Holiday Weekend

Reports indicate that fewer car accidents and truck accidents occurred this past Thanksgiving weekend, although California DUI arrests were up. California Highway Patrol (CHP) attributes the decline in accidents to an increased police presence. The Northern division of the CHP, which includes Mt. Shasta, Crescent City and Yreka reported no fatal collisions. In Colusa County, only one major injury accident was reported.

The CHP Valley Division, including Sacramento, mounted a similar crackdown over Thanksgiving, aimed at reducing drunk-driving accidents.

In the United States drunk driving is the leading cause of car accidents, followed by distracted driving. The lives of victims injured as the result of others negligence may change in an instant, often facing lifelong medical costs, physical pain and loss of enjoyment of life. Whether the increased police presence, or the growing awareness of distracted driving and serious risks of drinking and driving, fewer accidents and fewer DUIs is good news for all California drivers and passengers.

Santa Cruz Car Accidents Caused By Distracted Drivers

The Santa Cruz Patch reports that this past week the California Highway Patrol (CHP) began cracking down on distracted drivers. As part of a zero-tolerance enforcement campaign, the CHP will seek out and ticket those drivers who violate the state's hands-free cell-phone law. Reports indicate that in 2008, more than 30,000 California drivers had car accidents due to distraction. The leading cause of distraction - cell phone usage.

Other forms of distraction include eating, drinking, applying make-up, using a GPS, and adjusting the radio. As stated by a CHP officer, when California drivers are multi-tasking, they put both themselves at risk as well as increasing the risk of "injuring or killing their passengers, bicyclists, pedestrians or innocent victims traveling in another vehicle."

Put bluntly - no phone call or text message is worth a human life.

As a Sacramento car accident attorney, I agree. Whenever drivers takes their eyes off the road for just a moment, serious accidents and injuries can occur. Rather than take a chance, its always best to pull over or wait if you need to make a call or text. The risk of injury is far too great.
